That being said, when two or more people own the same property and cannot agree what to do with it, then a partition action is filed. The partition action is a type of lawsuit where the plaintiff asks the court either to sell the property and divide the proceeds among the parties or to allow one party to buy out the interest of the other(s). If you and your mother cannot agree what to do with the car, then that is your only option.
