I would agree wtih Mr. Frick's response to you to get a second opinion from another attorney. I have represented a number of personal injury clients where their claim was rejected by another attorney for one reason or another, but with spending some time discussing the claim with the client, I was able to find a legal path by which we were ultimately successful in making a substantial financial recovery for their benefit.
I agree with Mr. Gold that it is impossible to fully answer your question based on the short set of facts you gave. However, if the at-fault has no bodily injury coverage, he does not live with anyone with such coverage or is not on another relative's policy with such coverage, and you have no UM/UIM coverage, then generally you don't have much of a claim. Most personal injury attonreys will not go after an at-fault driver personally for damages (meaning going after someone who has no insurance coverage for their personal assets), because it is usually a fruitless endeavor. Sorry. But it is never a bad idea to consult with another attorney (or a few) before giving up on the claim. Some attorneys are more thorough than others in tracking down available coverage. Good luck!
