You could not sue for him.
He still had to do the time, so what did they do wrong that entitles you to sue
You cannot sue anyone ---you are not an involved party (no standing) to sue. Standing is a legal rubric that says a person must have a direct impact /harm/damage in order to sue.
Also a mistake does not mean a person gets a stay out of jail fee card. Even your brother would not appear to have a basis to sue.
