Is my case dead?
5 attorney answers
If you were working within the course and scope of your employment, which it seems that you were, this could still be a workers' compensation. I'm not sure what you said on the phone call that would make you think that your case would be dead, but that would be something to discuss with your attorney. It sounds like the truck was not owned by your employer, so you may also have a third-party case against that truck's company. You absolutely need to contact an attorney who is licensed to practice law in Florida and who regularly handles both workers' compensation and personal injury cases.

Further, this answer is only applicable to Florida, and is not intended to be used or referenced outside of Florida’s jurisdiction. Additionally, this answer is not intended as a substitute for legal counsel’s advice, and, it is suggested, that if you require legal advice, you seek counsel with an attorney licensed to practice in your State immediately.
No, your case is not necessarily dead, but more details are necessary before counsel can advise you. Were you in the course and scope of your employment when it happened? Was there an unsafe condition that caused you to fall? Who created the unsafe condition or failed to repair or eliminate the danger? What are the nature and extent of your injuries. All these and more would flesh out the details to determine whether you have a worker's compensation claim, a personal injury, both or neither. Good luck.
I agree with my colleagues. You may well have a workers comp and a civil case. You should seek qualified counsel ASAP.
Sounds like a WC case. See a doctor immediately and contact a lawyer ASAP but yes there still a csse.
Please note that the Law Offices of Evan M. Ostfeld, P.A., only practices...
It would appear that you have a potential Workers' Compensation claim and a possible 3rd party liability claim if there is a negligent non-exempt 3rd party involved. If injured, seek consultation asap. We all give free consultations.
