Yes, both parties are subject to the court order. You should exhaust all attempts to negotiate with your ex. If your efforts are unsuccessful, you will need to file a motion to enforce the order with the Court. Failure to comply with a court order can result in civil contempt charges which include fines up to $1,000 and/or 30 days in jail. Although neither is routinely levied by the courts, sometimes an admonition from the judge will compel compliance with the order.
