Age Discrimination Defined

Hello everyone. I'm Vincent White, I'm an employment attorney and today we've been asked to define age discrimination.

Unfortunately, that's not going to be very simple because in different Jurisdictions. We have different definitions of what actually constitutes age discrimination. Under the federal law, which of course applies in all states,age discrimination requires that you have a negative workplace consequence, and that the negative workplace consequences can be motivated by your age. This is pretty clear cut, this is the general understanding of what age discrimination is.

The targeting of people 40 years and older and that is how the federal statute is written. Now in New York City, within all five boroughs, things are a bit different. You'd still have the negative workplace consequence, but if that negative workplace consequence is motivated by your age, no matter what your age is, then you may have a claim.
